Marco passes away suddenly at the age of 52, leaving behind four children, a small country hotel and no Will.

At the time of his death, Marco was the hotel’s sole registered proprietor, while he and his brother, Tony, managed the business. Their mother, Rosa, however, disputes the notion that the hotel belonged solely to Marco. She claims to have contributed towards its purchase price and the ongoing operation costs and says it was always intended to be a family asset despite there being no written agreement to that effect.

Every few months, Rosa would come by and refresh the hotel’s look with new decor ideas and rearranged furniture across the dining and bar areas.

Following Marco’s death, Rosa continues paying hotel expenses to keep the business afloat. Tony takes over management of the pub, but tensions arise as the business struggles without Marco.

Marco’s children are advised that, under intestacy rules, they have priority to apply for Letters of Administration ahead of any creditor or other family member. None of them do so and the administration of Marco’s estate remains in limbo.

As years pass, one of Marco’s daughters begins requesting hotel financial records, details about Marco’s superannuation and an account of the estate assets. Tony claims that his long-standing involvement in the business entitled him to a share of its value.

Disputes arise as to whether the hotel forms part of Marco’s estate at all. Despite Marco being the sole registered owner, Rosa maintains that the property was intended to benefit other family members.

Several years after Marco’s death, Rosa applies for Letters of Administration as a creditor of the estate. Although this raised a potential conflict of interest, the Court is reluctant to appoint an independent administrator. Rosa is therefore granted Letters of Administration, subject to Court supervision and restrictions on the distribution of estate assets.
